Terms of Usage
These Terms of Usage ("Terms") govern access to and use of Conserworks Hub (the public home page, search, app shortcuts, and related features at conserworks.in), operated under the brand Conserworks by Conserworks Global LLP ("Company", "we", "us", or "our"). By using Conserworks Hub, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Service — Conserworks Hub, including the website, search bar, suggested links, app shortcuts, and sign-in integration with Conserworks products.
- User — any person who accesses or uses the Service.
- Linked Services — separate Conserworks products (for example C Mail, C Pay, C Social) that you may open from the Hub; each has its own terms and policies.
2. Eligibility
You must be at least 18 years of age and capable of entering a binding contract under applicable law. By using the Service, you represent that you meet these requirements.
3. The Service
Conserworks Hub provides a starting point to access Conserworks products, search the web or enter URLs, and view shortcuts configured by us or our administrators. We may change, suspend, or discontinue any part of the Service at any time without liability.
Search and navigation may send you to third-party websites or search providers. We do not control and are not responsible for third-party content, availability, or practices.
4. Sign-in and Linked Services
Sign-in may be provided through C Mail or other Conserworks authentication. Your use of Linked Services is governed by their respective terms and privacy policies. We are not responsible for outages, data loss, or conduct of Linked Services except as expressly stated in a separate agreement with you.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Infringe intellectual property, privacy, or other rights of any person;
- Transmit malware, spam, phishing, or harmful or fraudulent material;
- Attempt unauthorised access to our systems, accounts, or networks;
- Interfere with or disrupt the Service or its infrastructure;
- Scrape, reverse engineer, or overload the Service except as permitted by law;
- Use the Service for any unlawful or abusive purpose.
We may investigate violations and cooperate with law enforcement. Abuse may result in suspension or blocking of access without notice.
6. Intellectual property
The Conserworks name, logos, Hub design, and software are owned by or licensed to Conserworks Global LLP. You receive a limited, non-exclusive, revocable licence to use the Service for personal or internal business navigation only. You may not copy, modify, distribute, or create derivative works except as permitted by law.
7. Third-party services
The Service links to or displays third-party sites and products. We do not endorse and are not responsible for third-party services, policies, fees, or content. Your dealings with third parties are solely between you and them.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF SEARCH RESULTS, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR FREE OF LOSS OR CORRUPTION OF DATA.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSERWORKS GLOBAL LLP, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, BUSINESS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY LINKED SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) INR 5,000 (Indian Rupees five thousand only) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNT, THE CAP IN CLAUSE (A) APPLIES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to indemnify, defend, and hold harmless Conserworks Global LLP and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms or applicable law; or (c) your infringement of any third-party rights.
11. Suspension and termination
We may suspend or terminate your access at any time for violation of these Terms, legal requirements, or operational necessity. You may stop using the Service at any time. Provisions that by nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
12. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable mandatory laws, the courts at Chandigarh, India shall have exclusive jurisdiction over disputes arising from these Terms or the Service. You consent to the personal jurisdiction of such courts.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance. If you do not agree to revised Terms, you must stop using the Service.
